Tax relief measures

As of 1 January 2022, a significantly expanded catalogue of tax preferences has applied with respect to both corporate income tax (CIT) and personal income tax (PIT). Alongside the already existing tax relief measures, many new ones have appeared. Therefore, it is worth analysing the possibility of taking advantage of the tax savings that the tax relief measures provide.


Tax relief measures

The following tax relief measures, inter alia, may be of particular interest to entities carrying out economic activities:

  • R&D relief– aims at supporting innovativeness and technological development by way of deducting the R&D costs from income. Concurrently, the innovative employee relief is an alternative solution for those entities that cannot deduct the entire R&D tax relief due to the loss of or insufficient level of income;
  • Prototype relief – whereby part of the costs of trial production and the launch of a new product can be deducted from income;
  • Expansion relief – whereby costs of up to PLN 1 million incurred to increase revenue from sales of goods produced by the taxpayer (e.g. advertising campaign costs) can be deducted from income;
  • Robotisation relief – whereby up to 50% of the costs incurred for, inter alia, the purchase of brand-new machinery and equipment can be deducted;
  • CSR activities relief – whereby the expenditure incurred to support sporting, cultural activities or higher education, and science can be deducted from income;
  • Payment terminals relief– whereby the expenditure incurred on the purchase of a payment terminal can be deducted from income.

The so-called IP BOX tax relief should also be kept in mind. This relief is available both to CIT payers and PIT payers and makes it possible to apply a reduced rate of 5% tax to income derived from certain intellectual property rights (e.g. patents, or copyright held on a computer programme).


In addition, there are also reliefs that only apply to CIT or PIT settlements, for example:

  • CIT payers may take advantage of the relief for consolidation whereby the expenditure incurred for the purchase of shares of another company (up to PLN 250,000),
  • The so-called relief for return, which makes it possible to apply the PIT exemption for the period of 4 years. However, the annual revenue to which the exemption applies may not exceed the amount of PLN 85,528. Persons who meet the specified criteria, including, inter alia, those who moved their residence to Poland after 31 December 2021, may take advantage of the relief for return.

Thanks to the application of the tax relief measures, significant tax savings may be generated by the taxpayer. It is essential, however, each time to verify whether the conditions necessary to benefit from a particular tax relief measure have been met.
